The [SCHEME NAME] Loyalty Card scheme is operated by [COMPANY], trading as [CUSTOMER NAME], [CUSTOMER ADDRESS], Registered Number [xxxxxxxx] ("[CUSTOMER NAME]" or "we").
These Terms and Conditions apply to the use of the [SCHEME NAME] Loyalty Card (the “Card") for the collection and redemption of loyalty points at outlets run by [CUSTOMER NAME] (each a "participating outlet").
Use of the Card will constitute acceptance of these Terms and Conditions.

1. Getting your [SCHEME NAME] Loyalty Card
Applicants must reside in the UK and be aged 16 or over.
Employees of [CUSTOMER NAME], its associated companies, dealers, agents, contractors and subcontractors and their relatives may hold a card but can only use it to collect points on personal purchases.
The Card is free of charge and can be obtained at any participating outlet. It is not a credit or charge card and remains the property of [CUSTOMER NAME].
The Card does not need to be registered prior to use, but any points obtained prior to registration cannot be redeemed until the Card is registered. Registration can be done online via a simple application form - please visit [LOYALTY PORTAL URL] or, if you do not have access to a computer, please contact us at the address at the bottom of these Terms and Conditions.
You are entitled to a maximum of [X] Cards on your account.
You may cancel your Card at any time but if you do so, you will forfeit the right to any points that have accumulated on the Card that have not been used. We may ask you to return the Card or to destroy it in accordance with our instructions.
The Card must not be sold or traded in any way.
It is the Cardholders responsibility to mark their card as lost or stolen on the Loyality Card Website, alternatively this can be done via the helpdesk (see contact details at the end of T&Cs). [CUSTOMER NAME] will not be liable for any such loss of points.
Please notify us of any lost or stolen Cards at the address at the bottom of these Terms and Conditions.

2. Your Loyalty points
Loyalty points can be accrued and redeemed against certain purchases made in participating outlets.
Points cannot be accrued on the following purchases - [LIST OF RESTRICTED PRODUCT TYPES]. Other items may also be excluded from attracting points at some or all participating outlets at the discretion of [CUSTOMER NAME].
Points cannot be accrued or redeemed against any functions.
The points will be earned at the time of purchase, provided the Card is presented at the point of sale. If the loyalty machine is not working and/or if our systems are down due to an event beyond our control, you should still be able to accrue points. However, we will not be responsible for any loss suffered by you in such circumstances particularly if you are unable (in these circumstances) to redeem points against your current transaction. If you forget your Card we cannot add points to your Card at a later date.
Points will accrue on the entire transaction (provided no excluded items are being purchased).
Points can only be collected against purchases where a till and card reader is present.
You can check how many points you have and also redeem points at any participating outlet (excluding SPAR). You can also check the number of loyalty points you have collected on-line by visiting: [LOYALTY PORTAL URL].
A Card can hold an unlimited number of loyalty points.
You will earn [X] loyalty points for each complete pound spent, so if you spend £1.99, you will accrue [X] points. We may however change the number of points you can collect and will display notices in the participating outlets, should that happen.
You will only be able to redeem your loyalty points against purchases made in participating outlets, each point has a redemption value of one pence. The number of points used will be deducted from your Card.
When using your points to make a part of full payment, all available points must be redeemed against the purchase.
If you have a discrepancy regarding the number of points on your Card we may require you to provide receipts as proof of purchase to back up any claim, if the evidence is satisfactory (to us) we will change the points allocated to the applicable Card to reflect the correct position.
We will not exchange points for cash and reserve the right to remove from your Card any points that have not been redeemed for over 2 years.
We reserve the right to reject any Cards which have become unreadable and also to refuse to redeem any points which have been acquired by theft, fraud or any other means which are not in accordance with these Terms and Conditions, and the terms and conditions of any applicable promotion.

3. General
[CUSTOMER NAME] can cancel or withdraw the Card and or the scheme for any reason at any time on prior written notice to you. We can also change these Terms and Conditions. In both instances, we will endeavour to provide you with as much written notice as we can.

We will use or authorise the use of your information for the following purposes: to process your registration; to respond to your queries or requests; to administer your account and otherwise to undertake any of our obligations to you; to analyse your purchase history; and, only where your prior consent has been obtained, to send you details of products or services which may be of interest to you. In addition, in order to provide you with your Card as well as other associated services, it may be necessary for your information to be passed to a third party that will assist [CUSTOMER NAME] in providing such services to you. If we do this, we will ensure that anyone to whom we pass your information treats your information with the same level of protection as would be provided by [CUSTOMER NAME].
It is your responsibility to advise [CUSTOMER NAME] of a change to your personal details.
We control the personal data collected about you in relation to the Card. As part of your application, you will be asked to provide various personal data including your name, email address and mobile phone number. You have the right to ask for a copy of any personal data we hold about you subject to the payment of a fee and adequate proof of identity. We will provide you with such details within 40 days of your request. You also have the right to require us to correct any inaccuracies in your information. Any queries regarding personal data we hold relating to you and, additionally, any requests for copies or rectification of such data should be sent in writing to the address below.
We shall not be responsible or held liable for any default or event arising directly or indirectly from any cause or event beyond our control.
If any provision of these Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions, which shall remain in full force and effect.
We may transfer the benefits of these Terms and Conditions to a company in the same group as [CUSTOMER NAME] and if we do so, your rights will not be affected in any way.
These Terms and Conditions are governed by English law and subject to the non-exclusive jurisdiction of the English Courts.
